Who is responsible for what
You are the data controller. The contacts in your workspace are your customers, you decided to collect them, and you decide what is sent to them and why.
We are the data processor. We store and transmit that data to run the service you asked for, on your instructions, and for no other purpose.
That split matters in practice: consent to message someone is yours to obtain and yours to record. We give you the tools to record it and to honour an opt-out, but we cannot obtain it for you.
What the agreement contains
- The categories of data processed and the people it relates to
- The purposes it may be processed for, and the instruction that it is processed for nothing else
- Our security measures, and our obligation to keep them in place
- The subprocessors we use to deliver messages and run the infrastructure, named
- How and how quickly we notify you of a personal data breach
- What happens on termination: export, then deletion
- Confidentiality obligations on anyone with access
Your obligations under it
Briefly: have a lawful basis for holding the contacts you upload, honour opt-outs, and do not use the platform to send messages the recipient has not agreed to receive. Beyond the legal position, sending unconsented marketing is the fastest way to lose a WhatsApp sender.
How to get one
Email legal@amplifeed.tech with your company's registered name and address and the workspace it applies to. Standard terms need no negotiation and come back signed. If your legal team needs changes, send the redline and we will look at it properly rather than refusing on principle.
